Bakalářská práce je věnována ochraně dětských práv, a to z pohledu proměn postavení dítěte v rodině a společnosti a dále významným právním dokumentům, které znamenaly průlom v ochraně dětských práv. Práce dále slouží jako úvod do problematiky mezinárodních únosů dětí, při nichž dochází k zásahu do práv dítěte. Je zde popsáno soužití rozdílných společenských kultur a možné důsledky rozpadu rodiny na dítě. Problematika mezinárodních únosů je dále sledována z právního hlediska, a to vytyčením nejdůležitějších právních dokumentů, kterými je Česká republika vázána. Aplikace Haagské úmluvy je popsána v kazuistikách mezinárodních únosů dětí. V další kazuistice je přiblížena alternativní metoda řešení sporu, mediace, při níž došlo k uzavření dohody rodičů o pobytu a výchově dítěte. Práce v závěru poukazuje na nutnost prevence v oblasti ochrany práv dětí. |

This Batchelor's thesis is devoted to child's rights protection, from the changes of child's position in the family and society point of view, and also to significant legal documents which meant break-throught in child's rights protection. Thesis serves also as an introduction into the problem of international child's kidnapping during which intervention of child's rights is affected. Coexistence of different social cultures and possible impacts of family break-up on child are described here. The issue of international kidnapping is further pursued from the legal point of view by marking out the most important legal documents with which Czech Republic is bound to. The application of the Hague convention is described in casuistries of international child's kidnapping. The alternative method of the solution of a dispute is brought closer in the next casuistry, mediation, during which the parents' agreement on the residence and the nurture of the child has been concluded. At the end the thesis points out to the necessity of prevention in child's rights protection area. |
