Cílem bakalářské práce je popsat funkci starosty jak z historického hlediska, tak jeho postavení z hlediska současné právní úpravy. Práce je rozdělena na část teoretickou a praktickou. Teoretická část popisuje vznik a zánik funkce starosty, jeho povinnosti a pravomoci a jeho trestně právní, občanskou i politickou odpovědnost. Jsou zde uvedeny vztahy a povinnosti starosty k ostatním orgánům obce, jako je místostarosta obce, obecní zastupitelstvo, obecní rada a tajemník. Praktická část se zabývá novým legislativním návrhem, kterým je zavedení přímé volby starosty. Zhodnoceny jsou zde jak výhody, tak nevýhody nepřímé a přímé volby starosty. Její součástí je také rozbor vhodnosti navrhovaných legislativních opatření souvisejících se zavedením přímé volby starosty. |

The aim of this bachelor thesis is to describe the function of the mayor from a historical perspective and his position in terms of current legislation. The work is divided into the theoretical and the practical part. The theoretical part describes the commencement and the termination of mayor's office, his duties, powers and his criminal, civil and political responsibilities. There are listed the relations and obligations of the mayor to other municipal authorities, such as the deputy mayor, the municipal council and the secretary. The practical part deals with the new legislative proposal to establish direct election of mayors. Both advantages and disadvantages of the indirect and the direct election of mayors are evaluated in the work. It also includes analysis of suitability of proposed legislative measures related to the introduction of direct election of mayors. |
