Navrátil Pavel. Role PMS ČR v rámci alternativního trestu domácího vězení. Bakalářská práce. Brno 2012. 56 stran. Bakalářská práce je zaměřena na trest domácího vězení, který rozšiřuje škálu alternativních trestů, které mohou soudy v České republice ukládat pachatelům trestných činů. Trest domácího vězení se stal součástí českého právního řádu novelou trestněprávních předpisů od 1. ledna 2010. Bakalářská práce se zabývá právními i sociálními aspekty tohoto trestu. Autor nejprve v práci seznamuje s možnostmi alternativního řešení trestních věcí v kontextu restorativní justice a následně objasňuje roli Probační a mediační služby České republiky v trestním řízení, jakožto jedné z klíčových institucí v rámci výkonu tohoto alternaticního trestu včetně obeznámení se základní charakteristikou jednotlivých odborných činností PMS. Jádrem bakalářské práce je pak samotná úprava trestu domácího vězení, jeho právní úprava a samotná realizace v praxi. Pro srovnání autor komparuje českou právní úpravu s právní úpravou tohoto trestu na Slovensku a v Polsku. Součástí bakalářské práce jsou i případové studie, které na jednotlivých případech dokumentují součinnost PMS s orgány činnými v trestním řízení a nechybí ani aktuální statistická data, která se vztahují k tomuto alternativnímu trestu. |

Navrátil Pavel. Role of Probation and mediation service of the Czech republic in the enforcement of an alternative punishments of house arrest. Bachelors thesis. Brno 2012. 56 pages. Bachelor thesis is focused on the house arrest, which extends the range of alternative punishments that courts can impose in the Czech Republic for criminals. House arrest became a part of Czech law an amendment to criminal legislation from 1 st January 2010. This bachelor thesis deals with the legal and social aspects of the alternative punishment. Firstly, the author introduces the work with the possibilities of alternative criminal cases in the context of restorative justice and then he clarifies the role of the Probation and mediation Service of the Czech Republic in criminal proceedings, as one of the key institutions in the exercise of this alternative punishment, including familiarization with the basic characteristics of individual professional activities of Probation and mediation Service of the Czech republic. The core work is the general regulation of house arrest and its legislation and actual implementation in practice. By comparison the author confront Czech legislation with the legislation of the house arrest in Slovakia and Poland. The thesis also includes case studies that on individual ases documenting cooperation of Probation and mediation service with bodies active in criminal proceedings. Even, there are current statistical data relating to this alternative punishment. |
