Práce se zabývá problematikou střídavé výchovy v kontextu soudního řízení o výchově a výživě nezletilého dítěte. Popisuje průběh tohoto řízení, možnosti rozhodnutí soudu, význam znaleckého posudku, úlohu orgánu sociálně-právní ochrany dětí jako kolizního opatrovníka a otázku zjišťování názoru dítěte. Středem zájmu práce je institut střídavé výchovy. Práce popisuje právní úpravu střídavé výchovy, věnuje se také otázkám věkových kritérií, délce cyklu střídavé výchovy a vymezuje její pozitiva nebo překážky její úspěšné realizace. Dále se zabývá specifiky soudního řízení o svěření dítěte do střídavé výchovy. Vymezuje také jednotlivé formy odborné pomoci rodině, se zaměřením na rodinnou mediaci. Výzkum je věnován střídavé výchově v soudní praxi, kdy byly zjišťovány profesní zkušenosti a názory respondentů z kraje Vysočina, kteří se svou pracovní činností podílí na řízení o svěření dítěte do střídavé výchovy. |

The thesis deals with the problems of joint physical custody in the context of proceeding about upbringing and sustenance of minor child. It describes the course of this proceeding, the Court's decision options, the importance of the expert's report, the role of the authority of the socio-legal protection of children as a collision guardian and the question of the child's opinion survey. The centre of interest of the thesis is the institute joint physical custody. The thesis describes legal adjustment of joint physical custody, it also deals with issues of age criteria, the length of the cycle and defines its positives or barriers its successful implementation. Further it discusses the specificities of the judicial proceeding on the commit child in joint physical custody. The thesis also defines the different forms of family support, focusing on family mediation. The research is devoted to joint physical custody in judicial practise, which were professional experience and the views of the respondents of the district of Highlands, who are their working activities, participates in proceeding about the child's commit to joint physical custody. |
