Diplomová práce na téma ?Teorie dělby moci v současnosti ? garant ochrany lidských práv?? je zaměřena na jeden ze stěžejních momentů fungování demokracie, kterým je dělba moci, respektive teorie dělby moci, na jejímž základě je v praxi rozdělení moci realizováno. Objasňuje podstatu teorie dělby moci, její vývoj v historii politického myšlení, dále vysvětluje vertikální a horizontální dělbu moci i zásady, které je nutno dodržet, aby dělba moci byla skutečně funkční. Rozebrána je zde rovněž realizace teorie dělby moci u nás. Analyzuje odraz teorie dělby moci v Ústavě České republiky a v dalších zákonech, stejně tak se věnuje vývoji demokracie u nás a zamýšlí se nad údajnou krizí zastupitelské demokracie u nás. Pozornost je věnována jak soudní moci u nás, tak problému nezávislosti soudní moci. Součástí práce je i empirická část, která zahrnuje výsledky výzkumu, jenž zjišťoval postoje veřejnosti k uplatňování principu dělby moci u nás. |

The diploma project ?The Theory of the Division of Power at Present ? a Guarantor of Human Rights?? focuses on the one of crucial elements of democracy ? the division of power, in particular, on the theory of the division of power and the ground of which the division of power is being implemented in practice. It describes the substance of the division of power theory and its development in the history of political thinking. Further on, it explains the vertical and horizontal division of power as well as the prerequisite principles for the functional division of power in reality. The project also deals with the theoretical implementation of division of power in our country. It analysis the impact of the division of power theory in the Constitution of the Czech Republic and in the other laws, as well as the development and/or alleged decline of representative democracy in our country, and pays attention both to our judicial power and the issue of the independence of judicial power. The empirical part of the diploma project includes the survey data looking at the general public attitudes and opinions on the principles of the division of power implementation in our country. |
