Téma mé diplomové práce je ?Vlivy výslechového prostředí na výpověď dětí a mladistvých?. Výsledkem téměř každého výslechu je výpověď, na které se podílí velké množství faktorů, které ji ovlivňují a dotvářejí její skutečnou podobu. Je známým faktem, že právě výpověď bývá prvním a mnohdy jediným důkazem využitelným pro trestní řízení a proto je důležité, aby byla validní. Co všechno může výpověď dítěte či mladistvého ovlivnit? Beze sporu to bude vztah k předmětné události, které se výpověď dotýká. Mentální zralost vyslýchaného a v neposlední řadě i sociální status a rodinná výchova budou faktory, které budou konečnou podobu výpovědi ovlivňovat. Shora uvedené faktory jsou však ze strany osoby provádějící výslech neovlivnitelné, může (lépe řečeno ?měl by?) s nimi být seznámen a podle toho na vyslýchaného působit. Naproti tomu faktory související s výslechovým prostředím jsou ovlivnitelné. Nežádoucí se dá potlačit či alespoň zmírnit na minimum a pozitiv se dá využít k vytvoření hodnotnější výpovědi. Abychom však těchto vlivů mohli využívat, musíme stanovit určitá obecná pravidla, podle kterých bychom výslechové prostředí utvářeli či přetvářeli a tím dosahovali těch nejlepších výsledků v podobě hodnotných výpovědí dětí a mladistvých. |

The topic of my diploma thesis is ?The influence of the interrogation environment on testimony of infants and juvenile. The result of almost every interrogation is testimony, which is influenced by lot of aspects, which kapes and forms it's real figure. I tis known that the interrogation is often the first and only evidence which can be used for criminal procedure and therefore it is essential to be correct. What can though influence the interrogation of infants or juvenile? With no doubí it is the relation to particular event, which the interrogation applies to. The mental maturity of the interrogated and least not last the social status and the family background are aspects, which will influence the final interrogation. Unfortunately aspects mentioned above are not influenceable by the interrogator, but he or she must be aware of them and effect on interrogated accordingly. On the other side the aspects connected with interrogation environment are influenceable. The negatives can be restrained or reduced to minimum and the positives can be used to abtain more rewarding testimony. To be able to take advantage of these factors, we must set up particular general procedures to be used for creation and adjustment of interrogation room, to achieve the best results concreted in rewarding testimonies of infants and juvenile. |
