Diplomová práce se zaměřuje na zmapování oblasti mediace a seznámení s tímto typem řešení konfliktů. Představuje mediační činnosti a úkony prováděné v rámci trestního řízení. Teoretická část práce je věnována vymezení pojmu mediace v trestním řízení s krátkým exkurzem do historie mediace. Dále seznamuje s Probační a mediační službou České republiky, mezi jejíž kompetence patří právě mediaci v trestním řízení. Součástí textu je i srovnání činnosti Probační a mediační služby České republiky s rakouskou probační a mediační službou Neustart. Praktická část práce pak podrobně mapuje okolnosti samotného procesu mediace v trestním řízení. |

This thesis is focused on mapping of the area of mediation and familiarity with this type of conflict resolution. It presents the mediation activities and acts carried out in the context of criminal proceedings. The theoretical part of this thesis is devoted to the definition of the term of mediation in criminal proceedings with a short excursion into the history of mediation. It also introduces the Probation and Mediation Service of the Czech Republic, between its competence belongs just mediation in criminal proceedings. Part of the text is also a comparison of activities of Probation and Mediation Service of the Czech Republic with Austrian Probation and Mediation Service Neustart. The practical part of the work maps in detail the circumstances of the process of mediation itself in criminal proceedings. |
