Diplomová práce se zabývá problematikou správního trestání jako jedné z činností, jejichž výkonem je pověřena Celní správa ČR jako orgán státní správy. Stěžejním tématem práce je analýza takového jednání fyzických a právnických osob, jež ve svém důsledku vede k porušení či ohrožení zájmů společnosti nejen v oblasti celnictví (např. při správě spotřebních daní, při dozoru nad porušováním práv duševního vlastnictví ). S uvedeným úzce souvisí kategorizace jednotlivých přestupků a správních deliktů, resp. charakteristika řízení (ať už blokového či správního), ve kterém jsou za porušení právních předpisů pracovníky Celní správy ČR ukládány sankce. Součástí diplomové práce je kvantitativní výzkum, zaměřený na zjištění a analýzu postojů k úloze Celní správy ČR v oblasti správního trestání jak ze strany klientů Celní správy ČR, tak ze strany celníků. |

This thesis deals with administrative punishment as one of the activities with which it is entrusted to the Customs Administration of the Czech Republic as a government body. The main topic of this thesis is the analysis of such behavior of individuals and legal entities, which in turn leads to the violation or threat to the interests of society, not only in the field of customs (for example the administration of excise duties, in the supervision of violations of intellectual property rights, ). The set is closely related to the categorization of offenses and administrative offenses, respectively characteristic control (either block or administrative), which are in violation of the laws of the staff of Customs Administration imposed sanctions. Part of the thesis is a quantitative research aimed at identifying and analyzing attitudes towards the role of Customs Administration in the field of administrative punishment from both the clients of Customs Administration, and by the customs officers. |
