Práce pojednává o problematice spojené s neplacením výživného ve vztahu rodič - dítě. Tato oblast je v dnešní době aktuálním tématem, vzhledem k počtu rodičů nehradících výživné. V teoretické části práce je vymezena právní úprava, která se touto oblastí zaobírá. V této části je vysvětlen pojem výživné, stanovení výše výživného, možnosti právního vymáhání dluhu na výživném a druhy trestů. Nejpřísnější trest, trest odnětí svobody, je řešením, které je z ekonomického hlediska nevýhodné. S uložením trestu odnětí svobody vznikají značné náklady spojené s vězněním povinného a pokud odsouzený nepracuje, výživné nadále nehradí a dochází tedy k nárůstu dluhu na výživném. Pro rodinu i pro společnost je nejvýhodnějším trestem trest alternativní. V praktické části formou rozhovorů jsem zjišťovala jaké konkrétní dopady mělo neplacení výživného na nezaopatřené děti, jaké problémy neplacení výživného způsobilo rodiči věřiteli a jakým způsobem situaci řešil. |

The work deals with the issue of avoiding the maintenance obligation in the relation to children. Regarding the number of parents avoiding the payments, it is quite a problem these days. The theoretical part describes the legislation concerning this field. It explains the expression maintenance, setting its amount, possibilities of law enforcement in case of dept and possible sentences. The strictiest sentence, imprisonment, is inconvenient from the economic point of view. The execution of the sentence of imprisonment is connected with high expenses and in case the person does not work in prison, the maintenance is continuously not paid and the dept is rising. For the family as well as for the society therefore the alternative sentence is the most convenient. In practical part I deal with particular impacts of maintenance non-payment on the children, what problems it has brought to the people obliged to pay it and how they have solved the problem. |
