Diplomová práce se zabývá střídavou péčí jako jednou z možností porozvodového uspořádání poměrů dítěte. Je rozdělena na část teoretickou a praktickou. První kapitola je věnována historickému pohledu na rodinu a manželství. Podrobně se zabývá vznikem a zánikem manželství, vztahy mezi rodiči a dětmi, popisuje průběh opatrovnického a rozvodového řízení a vysvětluje roli orgánu sociálně-právní ochrany dětí při úpravě poměrů dítěte. Ve druhé kapitole jsou uvedeny možnosti úpravy poměrů nezletilého dítěte po rozvodu či rozchodu rodičů. Kapitola třetí se pak blíže zabývá střídavou péčí, zejména jejími klady a zápory, zájmem dítěte a možnostmi sociální pedagogiky v porozvodové péči. V praktické části diplomové práce je vypracováno pět kasuistik, na kterých je demonstrována střídavá péče v praxi. Poslední část práce je věnována statistickým údajům o podílu této formy uspořádání poměrů dítěte v rozhodnutích soudů. |

This thesis deals with shared custody as one of the options of post-divorce arrangements of child relations. It is divided into a theoretical and a practical part. The first chapter is dedicated to a historical perspective on family and marriage. It deals in detail with the formation and dissolution of marriage, relationships between parents and children, describes the process of tutelage and divorce proceedings and explains the position of social and legal protection of children in an adjustment of child relations. The second chapter provides the possibilities of adjusting the relations of an under-age child after a divorce or a separation of the parents. The third chapter deals in more detail with shared custody, especially its pros and cons, the child's interests and possibilities of social pedagogy in post-divorce care. In the practical part of the thesis there are five case studies elaborated in which shared custody is demonstrated in practice. The last part is devoted to statistical data on the proportion of this form of child relations arrangement in court decisions. |
