Diplomová práce se zabývá jedním z vážných společenských problémů v boji s kriminalitou, jenž se týká trestné činnosti mladistvých. Mladiství pachatelé rozšiřují okruh osob, potenciálních nositelů nebezpečí při páchání trestné činnosti a jejímu snížení a omezování by se proto měla v budoucnu věnovat ještě větší pozornost než doposud. V teoretické části jsou zpracovány poznatky, které jsem čerpal z odborné literatury. Rozvedl jsem zde problematiku kriminality mladistvých, možné příčiny jejich vzniku a vývoj kriminality mladistvých, kriminogenní faktory, sociálně patologické jevy a prameny trestního práva. Taktéž jsem se zabýval prevencí kriminality a preventivní kontrolou kriminality mládeže. Hlavní pozornost bude zaměřena na zákon o soudnictví ve věcech mládeže s ohledem na sankční opatření ve vztahu k mladistvým pachatelům de lege lata. V praktické části popisuji výzkumné šetření za užití obsahové analýzy dokumentů, jejíž cílem bylo zjistit a porovnat současný trend vývoje kriminality mladistvých na okrese Kroměříž v období let 2004 - 2007 v oblasti násilné, majetkové, mravnostní a ostatní trestné činnosti. V této části jsem čerpal data z vyšetřovacích spisů a z policejních statistik vedených na základě vyplněných formulářů o trestném činu a formulářů o známém pachateli. Podle statistických údajů se pokusím zhodnotit, jaké jsou hlavní důvody při páchání trestné činnosti osob mladistvých, a jaké příčiny a motivy jsou ve vztahu k trestnému činu. Výsledky diplomové práce přinesly poznatky vhodné k vytváření koncepcí cílené prevence kriminality mládeže. |

This graduation thesis deals with one of a serious social problem - the fight with the crime rate, which refers to a criminal activity of the adolescents. The juvenile offenders extend a sphere of the persons, the eventual carriers of the risk at crime commission and its decrease and limitation should be attend better than nowdays. In the theoretical part are compiled the the knowledge which I gathered from the specialized publications. I expand the questions of the juvenile offenders, potential causes of its origins and the development of the criminality juvenile offenders, crimogennive factors, the social-pathological phenomenona and the sources of the criminal law. Furthermore I deals with the preventative control of the juvenile delinquency. The main attention will be focused on the Justice Law in the affairs of the adolescents with regard to the sanctive precaution in relation to the juvenile offenders de lege lata. In the practical part I describe the reseach investigation for use of the content analysis documents, which the intention was found out and watched the current tendency of the juvenile delinquency development in Kroměříž region in the years 2004 - 2007, a range of violent crime, criminal propery activity, immoral offences and the other criminal activities. In this part I gathered the informantion from the investigative files and the police statistics recorded on the basis of the filled-in crime forms about the known offender. According to the statistical records I try to evaluate the main causes for commiting of the juvenile offender crime and also which causes and motives are in relation to criminal activity. The results of the graduation thesis brought the knowledge acceptable for the formation of concepts the specific preventation of the juvenile delinquency. |
